Motion to reduce child support by father

My son is working for handicap agency doing telemarketing and making minimum wages-His child support and arrearage take up most of his pay and he cannot afford food or even enough to pay his rent. What does the motion to reduce child support have to state in order for him to get help in lowering his payments to allow him to exist?

Re: Motion to reduce child support by father

You should retain a family law lawyer to properly address this matter and get his child support reduced accordingly. Basically a motion to reduce child support should include factual evidence such as the amount of his income, a brief outline of his other financial responsibilities, and how much he thinks it should be reduced to. The mother will be allowed to file a response with the court, and then the court will hold a hearing after that to hear the parties' arguments and render a ruling.

Keep in mind that the courts take into consideration the other parent's income when deciding what the non-custodial parent should be paying. There are child support guildelines that the courts follow, which estimate what a parent should be paying, but there are multiple factors that are used to calculate child support, which would be impossible to explain here, especially without knowing all of the parents' financial situation, etc.
