Can I move back into my home?

My husband filed for divorce. He has a lawyer, I do not. I left him due to a serious drinking problem he had. We had filed bankruptcy prior to this and our home was in Foreclosure. We both have garnisments because of this. I moved out and got my own apartment, but it has gotten to be more expensive than I thought. My question is can I move back into the home I left? My name is on the deed still and nothing has been signed. The house is still in both of our names. He says I cannot move back in. We have a 16 year old daughter who also resides with me, and would like her home back. Can I legally do this, and is there anything he can do about it? Thanks.

You have to fil a motion before the judge and ask for an order allowing you to return to the home while the case is pending. William S. Stern 248-353-9400
