want to move out of state with a child

hi i'll try to make this short after living in michigan lost 1 job due to company closing and another to company lack of work me and my wife thought it might be better to head south.my wife has a child from previous boyfriend who is now 12 years old due to reasons that he did something to when she was little the courts are only giving him visitation 5 hours in a public place. after talking to him about the he was fine with so we made a paper up for both to sign and on the day we were going he changed his mind.if we have to petition the court how can we do this.we were wanting to make this move for a better life a good job i already have lined up.and a better education for the 12 year old.can you please direct me in which way to go
