Legal Question in Family Law in Michigan

Want to move out of the state questions about custody laws

My daughter was born in Florida. Her father and I moved to Michigan in hopes of getting married. He started physically abusing me and after 3 years of dealing with it I left him. I've tried to make a life for her and I here and I just can't seem to get on my feet. Now I wish to move to Pennsyvania, my state of origin and where my entire family is. I'm 100% sure her and I can have a better life there. Her father and I never did get married but, he is on the birth certificate. We have never been to court over custody or support, she has always just been with me and I take care of her. He does not pay any support and periodically visits her. He has already been informed of the move. What should I do from here?

Re: Want to move out of the state questions about custody laws

I have received your question regarding moving from the state. You may do so without any court action. You may do this because there is no Order granting the girl's father any visitation or custody rights. However, you may consider getting an order awarding you custody. That would clarify your right to make living decisions on behalf of your daughter without agreement for her father. If you would like further information, please feel free to contact me or my associate, Helene Phillips.
