ex moved to texas
Hello,
My ex wife has recently moved to Texas for six months on military leave. I have joint legal custody of our minor of two years old. She has written a letter of power of attorney to her sister to give me a hard time. The child has lived with me 20 months out of 24.
I have recently filed motion to regain physical custody of my daughter and her sister filed motion against me. Our court date is in two weeks. I have been told by my lawyer they will not win, but I guess I need reassurance by others. Do you think they might have a chance?

it depends on many factors, and your judge. nobody can give you a yes or no answer with just these limited facts. you should listen to your lawyer who hopefully has experience in this area. also, you didn't state if the sister is attempting to get physical custody, or just to stop you from getting physical custody, so that is another issue - a court would likely favor you in this situation, since you are the natural parent. unless there are reasons you should not have the child. make sure you and your lawyer are prepared to demonstrate why it is in the best interests of the child for him/her to reside with you, your ability to support the child, your fabulous parenting skills, your clean house, ability to pay for preschool, daycare, etc. courts/judges want to know they are placing a child with a responsible person. good luck.
