Legal Question in Family Law in Michigan

Moving with child out of state

I am planning on leaving my husband due to emotional abuse and inreconcilable differences. We live in mi just 1 mile over the in state line, and my family lives in elkhart, in. I plan to move to elkhart with my daughter to get out of this unhealthy relationship. Can i legally leave mi with my daughter? It is only about 10-15 miles from where we currently live to where i am planning on moving, but i will be crossing from mi into in. This is my only option at this time. I do not have any family in mi. Also, my work is in goshen, in. My husband has been out of work for over 2 years now and is unwilling to help around the house. He has no income. The house that we currently live in is a double-wide on my husband's sister's land. I feel that if i try to force him to leave, that his sister will evict me from her land. Can you help me quickly!!!

Re: Moving with child out of state

You should immediately meet with a family law attorney. My guess is that the lawyer will tell you to file for divorce in Michigan and then ask the judge for permission to move to Elkhart. A 10 - 15 mile move may well be approved by your judge.
