Legal Question in Family Law in Michigan
My neice, age about 27, is mentally handicapped to a degree and has a one year old daughter. She has just found out she has STD due to the husband's affair(s) and wants to go home to Florida to be with her mother. Her husband has told her if she leaves the state, it will be considered kidnapping. However, they are still living together, no legal separation or divorce, no custody paperwork filed.
Would this be illegal for her to leave the state with her daughter?
