non-custodial parent not bringing kids back from visitation

First of all my husband and I have had custody of the minor children for almost 8 years. The mother has visitation every other weekend. On the last visitation she had, she called and said she was not bringing back the children because ''they didn't want to come back.'' My husband and I went to an attorney and paid to have an ex-parte order drawn up for full custody. The judge signed it. It--name removed--been over a week now and the kids are still not being returned. There is a court date set for Oct 28th for the mother to show cause. I am wondering if the judge will make the kids come back after the hearing...Or will he let them stay with her just because ''they want to live with her?'' The children--name removed--ages are 10, 12, & 13. My husband and I feel it is not in their best interest to live because we do not feel they should switch schools. Please let me know as I am missing them so much!

Greetings; To answer your question, I would need the whole case history, the name of the judge and opposing counsel and many other factors. This is where the expertise of a good attorney comes in. Obviously you had an attorney draft the ex-parte order. This question should be directed to your attorney. If they can not answer it, you need a new attorney.
