Non-custodial parent wants to claim my children for tax purposes

My ex husband wants to claim our children(2). One child every other year.The children reside with me 12 months of the year. If he is more than one month behind in child support can he still claim the children?

The custodial parent claims the child as a dependent deduction unless the Judgment of Divorce says otherwise.

You're ex-husband is incorrect. If the judgment of divorce is silent on the issue, the custodial parent gets the exemption, even if the other parent pays support. William S. Stern
