How to obtain legal gardianship of my brother

My parents have been divorced for 3 yrs and my brother has always lived with my mom. My dad didn't have much to do with him in any way other than child support. My mom decided to move in with her boyfriend a month ago and my brother didn't want to go. He wanted to stay with my dad. My brother stayed with my husband and I for 2 wks and then my dad refused to take him. My brother is 17 and I wanted to know if I could file for legal gaurdianship of him and if so, how? I am trying to make sure we still get child support and that we are solely resoponsible for him in case anything should happen, like an ER visit. Thanks!

Go to the probate court and ask for guardianship. It does not relieve the father of child support obligations. William S. Stern
