Legal Question in Family Law in Michigan

On-Line Divorce and Property Division

My husband and I have been married 15 years and anticipate a very amicable divorce through an on-line service. We have no children, and own very few assets (1 house, 2 cars, my pension), of which my husband (who has always made less than half the salary that I do), has expressed that he is not interested in taking ''half'' of these assets. We have discussed his taking 1 car and some percentage (approx 20%) of the pension, but he has no desire to take any % of the house value. uestion: If we list all of our assets on the online forms, do we have the right to ''prescribe'' what percentage of each asset we each ''desire'', or will Michigan Law automatically divide it 50/50 once we file the papers? Thanks in advance.

Re: On-Line Divorce and Property Division

You can divide your property any way you see fit so long as you bothswear in writing that it our intention so do so and waive any defects or inequities due to lack of knowledge of the law in a sworn writing filed with the court.
