Legal Question in Family Law in Michigan

paternity testing for child support

Several years ago (13 years) my husband assumed responsibility for raising a child for whom he was not the biological father, by allowing the mother (girlfriend at the time) to place his name on the birth certificate. After the break up of their relationship she then entered his name in the child support system. Since that time he has been receiving letters requesting continued payment of child support and threatening warrants for arrest. Efforts to discuss the case with friend of the court officials have proved futile. The mother now is not coooperating for a paternity test. What are his legal options.

Re: paternity testing for child support

Actually, the fact that he may not be the biolocial father of the child may be irrelevant to the court in Michigan. The court looks to whether he acted in the capacity of a parent to the child and whether the child looked to him as the father. He may be prevented from denying paternity, even if the testing would show he is not the biological father.
