possession of house
My husband and I are going through a divorce. He has been out of the house since January 13, and now in June he says he is moving back to the house. My lawyer has a motion pending to give me sole possession of the house during divorce proceedings, but that motion isn't scheduled before the judge until the end of the month. We have a 5 year-old child who has adjusted to ''Dad'' not living here (friend of the court has recomended that I have physical custody); the child has not spent a night away from me through all the proceedings. Can my husband just move back in without getting the okay first?

You can try to stop him by getting the local police involved if he shows up. Your attorney should consider having the motion heard by emergency motion, as soon as possible. In emergency situations the court will not wait. If there are domestic violence issues, that should be reason enough. For more info., please contact my office at (248)851-3171.
