Legal Question in Family Law in Michigan

power of attorney

There are 3 siblings & 1 of them has power of attorney over their father, and you suspect money is not being spent wisely and decisions are being made without consulting the other 2 siblings. Is there anything that can be done legally to gain equal control? Their father has a mild case of dementia, but is still somewhat in his right mind. When he dies, what happens to the power of attorney the 1 sibling now has?

Re: power of attorney

you can challenge the poa in court. If dad dies, the poa ceases to have power. But, if the funds are joint, there would be no probate. Contact me at www.kliszlaw.com to discuss further. Tim Klisz
