Legal Question in Family Law in Michigan

Praecipe for Motion and Miscellaneous Docket

I received a Praecipe for Motion and Miscellaneous Docket from the Circuit Court of Oakland County,MI. It states a motion date of Oct 05, 2005 with no time or location. The motion is a Modification of Judgement of Divorce in which Plaintiff requests modification of original agreement for sole claim of minor child for tax purposes. The original decree called for alternate years. What do I do about this?

Re: Praecipe for Motion and Miscellaneous Docket

Contact the Oakland County Circuit Court at (248) 858-0582 to verify the hearing date and time. When you speak to the court clerk, have the case name and number ready. If you are party to the case, you should appear on that date at the scheduled time. However, you may also wish to consult an attorney if you have questions rgearding teh substance of the motion. -GJR

Re: Praecipe for Motion and Miscellaneous Docket

There is a sticker on the top right that should tell you the name of the judge. Then call two-four-eight-eight-five-eight-one-thousand (lawguru won't let me put numbers in the answers) and ask for that judge's clerk. Give the clerk the case number and they will tell you the date, time and place of the motion. It most likely is on a Wedmesday at 8:30 a.m. As far as what to do about it, see a family law lawyer.
