Legal Question in Family Law in Michigan

PreNup

I am planning on marrying a girl coming here from Europe. I have a decent net worth (+ 300K) and she has little net worth. Is she legally intitled to the assets I aquired before the date of our marriage, in case we do get divorced down the road? Do pre-nups hold water in MI courts? If they do, I feel strongly that I should have her sign one.

You are wise to want a prenuptial agreement. They are normally enforced in Michigan. I would be pleased to speak with you about your needs. I will be available on Thursday afternoon at 1 8667665245.

Re: PreNup

Pre-marital assets can end up as martial assets if they are commingled with post-marital assets.

A pre-nupital agreement can protect the assets that individuals have accumulated before marriage. Furthermore, a properly drafted pre-nup will usually be valid in the State of Michigan.

I would be happy to sit down with you to discuss the advantages and disadvantages of a pre-nuptial agreement, and assist you in any other way I can.

Good Luck and I look forward to speaking with you.

Re: PreNup

Pre nups are valid in Michigan. If you keep you pre marital assets totally separate, there is a good liklihood that you'll be able to keep them in the event of a divorce. Most people do comingle their assets, however. Also, the longer you are married, the greater the liklihood that the wife would be able to get assets in the event of a divorce. Feel free to give me a call. William S. Stern
