Promissory Note Payments in Divorce
My ex-wife and I had our final judgement of divorce issued on 3/31/2003. In that divorce judgement she agreed to, and the court ordered in the judgement, for her to pay me $280 per month for 36 months, to pay-off some old debt. At the time, I also typed-up a separate paper which she signed agreeing to these terms. Shortly after the divorce she moved to NY. She made the first two payments as agreed in April and May of 2003. After those payments she kept claiming poverty and asked for some time. I kept talking to her for another 4 months or so, and she kept promising that she would pay eventually. Now, for the past 3 months, she will not respond to e-mail or written letters, and has not paid at all. What recourse do I have? How can I force her to pay? I considered filing a motion for garnishment, is this my best option?

Garnishment is not a bad idea. Motion for contempt may be another. Bill Stern 248-353-9400
