Legal Question in Family Law in Michigan
Property
My husband left me to pursue a Gay life style. He has not given me any money since he left. His debt is horrible. He used his credit cards for personal items for himself. I have my own credit. Are credit has always been separate as well as our last names. He just bought house. I do not know how he did this but he did. I would like to buy a house of my own. If I do, will he be entitled to half?

It is highly doubtful that he would be entitled to money from your house because you acquired it after the separation. It matters how the money to buy that house was acquired. Why don't you file for divorce? Bill Stern
Re: Property
Hello, I have received a copy of your e-mail regarding your husband's change in life style and the question of a divorce. The answer to property settlement issues revolves around whether the asset is a "marital" asset and what is "fair." The Court will try to divide "marital assets in such a way as to obtain a "fair" property division. The Courts will occasionally invade the "non-marital" assets if necessary to accomplish that "fair" division of assets. You really should discuss the details of your case with an attorney. That will give you an opportunity to review the options available to you and the likely fees involved. Feel free to give me a call if you wish. Divorce litigation is one of the areas of concentration for my firm. John C. Talpos (http://www.Mich-lawyer.com) (248) 743-6800
