Legal Question in Family Law in Michigan

Property Settlement - Divorce

I am going thru divorce. The problem is in the property settlement.I sent about $60,000 to my parents in India after the marriage, but that money was earned before the marriage in Canada. I got married after I moved to the United States about 2 years ago. I submitted my W2 which clearly shows my 2 year earnings, after the marriage, is $100,000.00. My expenses clearly shows that I spent $126,000.00. I have a credit card debt of $26,000.

Why the court is asking about the money that I earned before the marriage in Canada? I don't have any of those records. But anybody sees my W2 and my expenses, it's crystal clear that whatever money ($60,000) sent to India was earned before the marriage.

Could you please tell me why should I give half of $60,000 to my wife?

Can I fight this case at the Michigan Court of Appeal?

Re: Property Settlement - Divorce

It sounds like you already have a lawyer. It also sounds like you don't tru7st what the lawyer is telling you. You are looking for a lawyer to tell you what you want to hear. The point is, even though you brought pre-marital money into the marriage, it has to be disclosed. Then, it is up to the court to determine what is premarital and post marital. Sometimes premarital can be excluded while the increase in value of the property during the marriage may be marital. It is somewhat complicated but I can guarantee you that your failure to disclose will not benefit you. Bill Stern 248-353-9400
