Legal Question in Family Law in Michigan

public assistance and co-habitaion

Okay, so I didnt know where else to post this. But here is my problem: I have two beautiful children and am applying for public assistance (medicaid because I dont make enough and my employer doesnt offer insurance coverage). However, my case worker is saying that they will count the income of my boyfriend (not the father of either child) against me. Is this legal? He is not financially responsible for any of us? The lease and all of our bills are in both of our names. We file taxes seperate every year, and he can not legally cover my children with his medical. If they count his income, my children dont qualify for medicaid, but if they dont, the kids qualify. What can I do?

Please help.

Legal Aid has attorneys that specialize in "public benefits." They have a great deal of expertise in the field. I suggest that you phone them.
