Legal Question in Family Law in Michigan

qdro - Contesting

Can a QRDO order be contested? Child molestation is involved in my particular case forcing a divorce. If the individual who is to receive a portion of someone's retirement agrees that they are not entitled, can that order be reversed?

Child Molestation has nothing to do with QDROs. It is possible for someone to contest the ordering of a QDRO. If that happens the judge makes the decision. But once the rights to someone's retirement is waived, one cannot come back later to get it (unless it's within the time to appeal)
