Reduction in Child Support

Is is necessary or advisable to retain an attorney to get child support reduced in Michigan. Friend of the Court has a form they say you just complete, submit your latest paystubs and a letter and they will submit for review. Does it really work that way, what are the chances of getting the support changed just based on the payroll info?

Part of it depends on whether your ex will oppose the reduction or not. The FOC will review your info and make a recommendation - if there are other factors besides your pay which you think entitle you to a reduction, such as having the kids a lot more than you used to, etc., mention that in your submission to the FOC.

You can always try that first, and see if you are happy with the recommendation/reduction, and then if not, hire an attorney to file a motion in court and argue the reasons why you are entitled to a reduction. If it is Wayne County FOC, it takes a while for them to evaluate your info, so you'll have to be patient.

What an attorney will offer could be valuable, b/c that person would have (hopefully) a track record with your judge.

The FOC decides, however, so you want to make your case as convincing as possible, answering all the "why should I" questions the FOC officer is likely to have. FOC decides, judge issues an order if s/he agrees. And, they usually do.

Note, that you can mediate child support, so if your ex can be convinced, and agree in writing, then FOC will probably go along with it.
