Legal Question in Family Law in Michigan

What happens if a rehearing is scheduled

I just had a hearing over custody and it ended in my favor, I'm pretty sure that my ex-husband will file for a rehearing. I was wondering if he will automatically give him one or does he have some sort of burden of proof that something was missed or that the cour made an error?

Re: What happens if a rehearing is scheduled

If the hearing was before a referee, then he will appeal to the judge. If the hearing was before the judge, on a motion for reheairng, there is no oral argument, unless the court allows it, which they rarely do. Also, in a motion for rehearing before the judge, you are not allowed to even file a response, unless the judge asks you to. William S. Stern
