reimbursement for child care expenses

My ex does not want to reimburse me for any of the child care expenses that I pay my mother to watch my 6 year-old son while he is not in school and I am in graduate school full-time. My ex claims that he has ''first right of refusal'' but those words are not in my final divorce papers, and in fact there is nothing in them at all about child care. When Friend of the Court made their recommendation for child support, there were no child care expenses included because I was then a stay-at-home mom, but now my situation has changed. If we end up in court, what is the most likely resolution to this? Thanks for any reply!
