Removal of a child from their legal parent or guaridian without a hearing
I am legal custodial parent and thought there was a hearing on the 25th of Aug then showed as well as my ex and found out that cause i was not served that it was illegal then made a date for a hearing for the 15th of Sept then on the 29th of Aug the state police came with a supposed court order for me to release my son for emergency parenting time which he is enrolled in school and will interrupt his school year the paper that the officer handed me said nothing other then that and that the court hearing had been moved till the 22nd of Sept. The document i recieved was dated the 27th of Aug and he waited till that Saturday till 2 am to come and remove my son. This is all wrong but I have no clue on how to go about fixing this or getting my son back i reside in Alpena County and his father resides in Wayne County. I also have papers proving he tried kidnapping my son a the day of the 25th supposed court hearing. Of any court hearing am i to be served or certified with a notice which i have only gotten one and that was sent in the mail nothing of that sort. Can u help?

Basically, you need a good family law lawyer. The lawyer will look up the file and take appropriate action. It sounds like it has the potential to be extremely contentious and time consuming, since these issues will require a small trial. It could be expensive. However, to go without a good lawyer on such important issues is more expensive in the long run. It sounds like your ex is going all out.
