Legal Question in Family Law in Michigan

Retirement sharing and spousal support

I have been divorced for 6 years and recently found out that my employer at the time had a retirement plan administrator who did not honor my former spouses QDRO. My retirement account remains whole and in my name. I am concerned that at some time my wife will declare her retirement and want payment from me. The spirit of the divorce decree agreement was that she would be entitled to half of the then vested and accrued amount. I stayed with that employer for another 5+ years so the final total vested and accrued amount is much different than the amount at the time of divorce. What should I do to protect my retirement fund?

Re: Retirement sharing and spousal support

There are groups and lawyers who specialize in fixing QDRO problems. Contact a local family law specialist and ask who they use. Most of the groupls and lawyers who specialize in such issues like to go through other lawyers. This is how most lawyers deal with these issues now. An example is QDRO Express. William S. Stern

Your judgment of divorce and your QDRO need to be reviewed. Either contact your divorce attorney or some other experienced attorney to work with you.
