Sale of marital home

In the divorce, my husband got the house, but he is required to pay me $10,000 for my share of hte equity within 3 years. He is currently in default on the mortgage which is still in both of our names. I never signed a quitclaim deed. Can I sell the house to avoid more credit trouble and get my $10,000?

If you are fearful that the house may sell without protecting your equity, you may ask for immediate sale of the house. Whoever buys the house may buy it subject to your lien. However, it is possible that the foreclosure could impair your ability to get your money out of the house. Contact a family law lawyer. If you wish to speak with me, give me a call.
