I have received a copy of your posting regarding your rights in a legal separation. The quick answer is that they are the same as in a divorce, except that you cannot get remarried. There are normally provisions regarding property settlement, child custody, child support parenting time, and alimony. The major difference in addition to being unable to remarry is that health insurance benefits may remain in place. Call my office if you have further questions.

There is no such thing as "legal separation" in Michigan. There is a thing called an action for separate maintenance. This is not the equivalent of a divorce, and you are still considered legally married with almost all the same rights as a married person. for more info., please contact my office at (248)851-3171.
