Separate maintenance is when the parties obtain a court order defining their economic and potentially, their child custody, visitation and support arrangements without actually getting divorced. It is sometimes used when parties do not want a divorce due to health insurance issues or due to religious issues. It is the same amount of work as a divorce and involves going to court, just like a divorce. William S. Stern

Separate maintenance is almost a divorce. The parties divide property and so forth just like in a divorce, but cannot remarry. Is is easily converted into a divorce judgment by either party.
