Legal Question in Family Law in Michigan

Seperation and Affairs

My wife has been in and out of the hospital for alcohol abuse for the past 2 years. We could not deal with the constant drunk encounters and I called the child protection agency on the situation( I had exhausted all other avenues ). They suggested I move out with my 2 sons to get them out of the environment. I did. My wife has been seeing someone (out in the open) while we are still married. What is my financial responsibility to her since I have the kids, she does not work, and I pay the bills. I have borrowed money to pay 2 residences and our money is disappearing. I also have a daughter in college. What about the open affair. Sometimes she tries to get our children to go out for dinner with them I know my answer is a divorce. Please advise on the above.

Re: Seperation and Affairs

Although Michigan is a no-fault divorce state, there are many considerations when considering financial responsibility to a spouse post-divorce, including whose fault it was the marriage broke up. Considering it sounds like it was her fault, both in terms of alcohol and the affair, I cannot fathom that you would have to make a significant financial contribution to her. However, other factors, like length of the marriage and income earning ability are also considered. In any case, it would be wise to have counsel for this.
