I am thinking of leaving my husband and taking our 1 year old daughter with me--name removed--What legal action do I need to take prior to leaving, so that I am not accused of kidnapping--name removed--We would stay at my grandmother's which is 30 minutes away.

You should notify your husband where you and your daughter will be staying and you should meet with a family law attorney quickly.

As long as there is no other custody order in place, you can take your daugther, but simply notify your husband where you are going or notify a mutual friend if you are in fear for your life. Contact a family law attorney immediately, even if you don't want to file for divorce, as you need to get some temporary orders in place regarding child custody and support to avoid any future problems. It is not kidnapping for you to leave with your daughter. Unless there is a serious risk of domestic violence, you should inform your husband where you and your daughter will be staying.
