Shared Economic Responsibility
My ex and I have joint physical custody of our 2 minor daughters. The parenting time agreed to was that the children spend the school year with Mom (me) and visit with Dad 3 weekend per month and in the summer the schedule reverses with the exception that the children are with me during the day.
To accomodate Dad's sports activities, the girls will be with me through the dinner hour 2 days a week.
Due to the number of nights the girls will be sleeping at Dad's the FOC referee used the shared economic responsibility formula for setting child support.
My contention is that the burden of economic respnsibility lies most heavily on me as I have the girls throughout the school year where expenses are greatest and I have them every day during the summer with the exception of one weekend per month they will spend with their father. They will only be sleeping at Dad's 4 days per week in the summer.
My question is does this scenario comply with criteria for the Circuit Court to be able to deviate from the formula?

Dear Madam:
This is in response to your email of June 13, 2001, which this office received on June 28, 2001.
Shared Economic Formula should be applied in your situation when the father has least 128 overnights with the children.
