Had my son taken away from me

Hi have a question i have been with my son since birth cared for while his mother worked.My son was born in nyc mother went on visit to detroit and stayed i went later to save family structure in laws where very aggresive towards me i left to keep from harm father threaten me.Me and mother broke up because of parents . I have a history couseling and teaching children.I wanted the child the mother didnt at first she has a history of abortions does not want anymore children. I want a family i have called and its been about 3 months since i seen my son do you think i have a joint custody case even visitation rights????????????? I live in nyc where my son was born and she lives in detroit,michigan in the penrod area

Hello, I have received a copy of your e-mail regarding custody. Yes, I think you have a very good chance for a visitation order and a decent but more difficult chance for custody. You would be best advised to litigate in NY, if possible. If the child has not yet been in Michigan for six months, then NY still has custody jurisdiction.

You can file a Writ of Habeas Corpus in the Family Court, but you must act quickly.

You do not mention whether you are married to the mother. If so, suggest you file a divorce action in NY, before she files in MI.
