Spousal support

In my divorce, I was ordered to pay my ex-wife $217.00 a month for care of the house we legally jointly own. Whwn the house is sold, I only get $35,000 and my ex gets everything else. The judge ruled this way because, at the time she was living in the house w/the kids. My wife moved to a diffgerent town over a year ago and the house sits empty. I just found out today that my wife is renting the house out. Since we both, jointly legally own the home I would like the following questions answered. Since she is now renting the house out for more than the house payment, do I have a legal right to end spousal support, the rent she is charging, and recieiving pays for the house now. Since I am paying spousal support to help pay for the house am I entitled to any of the rent money she now gets?? And lastly, Is there any way I can get a larger amt when the house is sold since she is getting spousal support and she is now getting additional income for renting the house.

The only way to handle this is to bring the matter before the judge and argue that the renting of the house by the wife are circumstances unanticipated at the time that the judgment was entered. It sounds like you have some good arguments. William S. Stern
