Legal Question in Family Law in Michigan

can a spouse file for divorce in a state that we vacation in for about 5 months of the

year?. We live in Mi. and vacation in Fl. but never more then 5months.

It depends on what the jurisdiction and venue requirements are for that state. Each state requires you be a resident for a certain amount of time before you can file for divorce. Michigan, for example, requires you to be a resident of the state for at least 6 months and the county for at least 10 days before you file for divorce.

if you only take a s*** in Florida, it seems unlikely that either of you would have declared Florida to be your state of residence. You should check with a Florida Attorney to get clarification about the Florida law. However, if Michigan has always been your state of residence, it seems that michigan would likely be the proper place to file.
