Legal Question in Family Law in Michigan
Can he steal my son during a visit?
My husband and I were married in Colorado in 2007. Since he had abandoned me while 7 months pregnant, gotten kicked out of the army, and has paid no support to me or my son. I moved back home to Michigan since abandonment & he has moved back home to Alabama since military discharge. My son was born in Michigan in May of 2008. Now my husband wants to reconcile, and wants my son & myself to visit him in Alabama to try to salvage our marriage & to finally meet him.
My concern is that he will try to take my son away from me while we are visiting...not that I necessarily believe he would do that, but I didn't believe he would ever abandon me either. You just never know.
It's the whole 'possession is 9/10ths of the law' kind of deal. I don't want him to have possession of our son while we are visiting, and then be able to keep him down there.
Is there any way I can get temporary custody for the visit, so that if he does try this, I have something to back me up so I can have my son back and take him home to Michigan?

If you don't already have custody established you should do so before having any sort of visit.

Your situation is tricky and complex. I'd advise meeting with an experienced family law attorney before making any decisions.
