tax/exemption for child

can I claim my child on my taxes every year??? Iam the father and am the noncustodial parent.

It depends on the terms of your divorce judgment and/or child support/custody orders. Usually there is a provision in there addressing the issue. If not, then you need to discuss this with the mother, because if you both claim the child, and then one of you gets audited, you will be in trouble with the IRS.

If you can't reach an agreement with the mother on this issue, then you'd have to file a motion with the court and let the judge decide.

No, you cannot. Does your judgment of divorce address this?
