Temporary Custody

We are keeping 2 children because the mother is in jail. She is expected to be there for approx. 1 year. We don't have legal custody but they do live with us for now. My fiance' is her uncle. She has no other family. What can we do under the law to make sure that the kids are not placed in foster care?

Although you cannot be certain, I advise having your lawyer do a guardianship for you.

While the Court makes a custody decision at its discretion there is a strong desire to keep children within families where ever possible.

I don't know the answer to your question but if I were you, I'd go to the probate court and get guardianship of the kids. Get the mother's written permission for you to be guardian. Try to get the father's permission if you can find him. William S. Stern
