Legal Question in Family Law in Michigan
Ugly divorce, I filed in February 2007, finalized August 2008, then appealed by ex-husband-still not finished. We both sold our houses and built the dream home and I put the first 50K down on dream house. Ex in contempt and just paid biggest part of settlement last month.
Question---am I entitled to interest on my money he has had control of and profited from, for the last 3 1/2 years??
I have bought a house with no $ down and am paying huge interest because of it---and he is making $ off my money. His lawyer says no, my lawyer agreed, but judge at one point in 9-10 hearings did order it. My lawyer says drop it but I think I should be given % on that money

If I understand you correctly, your lawyer told you to "drop it" without giving you any explanation. If this is an important issue to you (which it sounds like it is), you should ask your lawyer for the reason he/she thinks you should "drop it". These reasons may be based on law, reason, strategy, common sense, or cost/benefit analysis. If you are still unhappy with your representation, then you might consider getting different representation.
Without more details, it's difficult to give you an answer on this issue. I'm not sure how he was holding your money and how he profited from it. If the money was being held in an interest-earning account and a court determines that you are entitled to the principal, then you may be entitled to the interest.
Good luck,
