Re: Unmarried childbearing-legal?

Dear Madam:

Regardless of whether it is permissible for you to conceive a child through the use of a fertility clinic, your boyfriend will not be legal father of the child unless he specifically consents. Therefore, if it is your intention that the two of you have a family, I suggest you wait until you are both ready to begin this process.

With regard to the legality of conceiving a child through the use of fertility clinic, in Michigan there is specific statutory language that governs fertility clinics. However, without reviewing the language I am unsure of what limitations the law places on you, if any. However, if at a future time both you and your boyfriend are willing to proceed, feel free to retain our firm to review this matter with you.

Finally, most fertility clinics have literature regarding the legal aspects of their services available to the clientele. I suggest that you contact the clinic you are interested in to request such information.

Sincerely,

Michael D. Eberth
