Legal Question in Family Law in Michigan

vacation out of state

the ex wants to take our 6 yo daughter out of state to idaho for 2 weeks. She ask me for permission, but i denied my consent. She has soul physical, but we have joint legal custody. She keeps threatening me that she will still go even if i don't agree. If she were to follow through with this, would it be considered parental kidnapping? Thanks in advance

She does not need your permission to take your daughter on vacation out of state. It is not unlawful.

Unless your judgment of divorce or related child custody orders prohibit her from taking the child out of state without your permission, then she is not doing anything illegal by taking the child on vacation, and it would not be considered kidnapping, especially since she has sole physical custody, versus joint.

I would just do what's best for the child, and feel free to obtain the contact information for where they will be staying so that you can keep in contact with your daughter and for emergency purposes, if you are concerned.
