Legal Question in Family Law in Michigan
Visitation Enforcement- Ex name's her price or no visit.
My husband is a divorced father of an 8 year old girl. She lives in Mi. and we're in Az.(husband is stationed here USMC).The divorce decree says he has joint legal custody. It also states he has summer visitation starting a week after school ends and ending a week before school begins. His ex and her father in law(FOTC) went to court and got a modification of parenting time(he now gets 4 consecutive weeks with his ex getting a weekend of visitation during that time). My husband was never notified of this process, his ex said that she just told the court she didn't know where he was(lie). He has attempted to make arrangements for this summer, with no avail. His ex says she's unsure when school ends, that she has signed her up for summer activities and she doesn't want to visit. So, we bought a plane ticket. When he told the ex, she said they had to agree on a date and that he had to buy 2RT tickets so thier daughter could fly back to Mi.for her weekend visit. She then told her child that if she flew she could die or get molested. Now my husband has to buy 2 more RT tickets to fly with her. He always pays support. Ex asked him for extra money. When he told her he couldn't, she said he won't see her til he pays. What can he do?

You have to have very specific dates in the order regarding visitation. That way, if he arrives for visitation and she will not produce the child, the police will get involved to enforce the order. Agreements in this situation that are not in writing will not work. As far as what the ex did, you need a lawyer in Michigan to address the problem with the court. William S. Stern 248-353-9400
