Legal Question in Family Law in Michigan

visitation

My ex and I have joint legal custody; I have primary physical. We've been divorced for 10 months. He lives two blocks away and has not seen or talked to his kids for several months. He makes plans, but never shows up; doesn't buy Christmas or birthday presents. Would it be possible for me to get sole legal custody until these conditions? Should I try?

The general rule on custody modification or parenting time modification is that there must be a change in circumstances since the entry of the judgment or custody order. The facts you have presented could certainly be a basis for a motion in change in custody, and if successful, modification of child support.
