Legal Question in Family Law in Michigan
Ex hasn't visited child in three years
My ex-husband has not seen or contacted our daughter (6 years old)in three years. He does pay child support. However, he has not been there for birthdays, Christmases, or other important things in her life. He recently contacted me and wants to see her. We have joint custody, I know the law, but how can he come back into her life and resume parental responsibilities that he neglected for the past three years? I know that it is good for the child to have a relationship with both parents. But three years is a long time for a child. There should be some law or something. I want to be careful because I can't trust him. I haven't contacted him back yet. Any advice?

My advice is: (1) realize that you really DON'T know the law, and (2) hire a lawyer to represent you that DOES know the law.

My thoughts are to file a motion to terminate joint custody. Then just allow him a bit of visitation. The child will therefore have a relationship with her father but he will not have say in any important decisions in the life of your child. Feel free to give me a call at 248-353-9400 William S. Stern
