Legal Question in Family Law in Michigan

Waiving the 6 month waiting period for divorce.

I have one 15 year old child and have filed for a divorce in the state of Michigan. Is there any possible way to get around the 6 month waiting period?

A court has the power to shorten the six month waiting period to as few as 60 days upon a proper showing of hardship or necessity. You must petition the court to shorten the period. If you have any further questions, please contact me at www.lawgreg.com.

Hello, I have received a copy of your e-mail regarding waiving the 6 month waiting period in a divorce. The practice varies around the state and from Judge to Judge. However, the general rule is that the Court will shorten the waiting period but not under a minimum of 2 months. You must show a good reason for doing so and it is discretionary with the Judge. Good Luck. John C. Talpos (http://www.Mich-Lawyer.com)

It is possible to waive the six months. As long as your spouse and you agree to waive the period and you have a valid reason for doing so most judges will go along with the request. Prior to asking the judge to waive the six months make sure that custody, support and property issues are settled. Before filing for divorce make sure it is what you really want to do and that counseling is not an option. Good luck to you.
