Warrant issued for mother

My stepdaughter's mother has had a warrant issued for her arrest, due to not

paying fines ordered by the court. These fines were due to a false police

report being filed, nothing to do with current situation. Can we withhold

visitation until mother proves she no long has a warrant? Stepdaughter is only

6 years old and has already watched her mother get arrested once this year.

Father and mother have joint physical and legal custody. Mother only gets

daughter everyother weekend due to lack of transportation.

No, you may not withhold visitation. The warrant is none of your concern. If you withhold visitation you risk getting arrested for contempt.

Since you have adequate time, and you are not faced with an emergency decision, ask the court for an order suspending parenting time until the warrant issue is resolved.
