ex will not follow through with judgement and let me have my belongings
My ex has given me so much grief that I filed a small claims order to take him to court for not letting me receive my articles of property. He has threaten to throw my things out and will not give me all our articles listed on the judgement. He says you take these or nothing. Lied about running over the children go-cart. Wanting to give me a broken scanner that is not even his. Trying to pull the wool over me. He always likes to be in charge. So now he delivers these articles on my front lawn. Everythings ok, but the scanner is not the one that I bought. It is the one we bought his father for christmas a few years ago. He wants to keep the scanner for himself. He will go to anything to lie, and not give in. What do I do? Do I still take him to small claims court for the scanner and my court and paper work fees. Or do I let him win. this scanner that he should be giving me is abot $250.00. The one he gave me is broken and won't work. Please help, my court date is March 13, 2006. I can not afford to call and talk to a laywer anymore. I still owe a couple grand yet.
Please I would appreciate any help that anyone could give me at this time. Again thank you for reading and taking the time anwser my question.

It may not be worth it to go to court over a scanner, but since it sounds like you have already filed the complaint, you may as well follow through. If there are items of personal property listed in the divorce judgment that your ex-husband has not given you, you can file a motion for an order to show cause, but you may need an attorney to help you with that.

You don't belong in small claims court, you belong back in front of your divorce judge. You should have your divorce attorney, or another attorney help you and ask the court to order your husband to pay for your attorney fees.
