Legal Question in Family Law in Michigan
X-wife moving
My fiancee and I purposely bought he house near my x-wife so I could see my daughter half the week and be able to drive to and from school. Now my x-wife is planning to move and place my daughter in a private school about 60-70 miles away. She has sole physical custody and we have dual legal custody. how far is she alowed to move from me and will she have to meet me half way to exchange our daughter? With dual legal custody do I have a right to oppose to my daughter going to a private school wiche I could absolutly not afford?

Since you have joint legal, you have standing to object to the school. Also, you can insist on a fair arrangement for visitation, etc. You will probably have to have these matters addressed by the court. William S. Stern 248-353-9400
Re: X-wife moving
Your ex can move up to 100 miles from you without the court's permission. However, she cannot unilaterally decide to pull your child out of one school and enroll her in another. Because you have joint legal custody, you can object. Were I you, I would file a motion in court before school starts.
