My wife's works for a company with less than 50 employees, she has a ''covered Illness under FMLA,

Can she take the FMLA?

what are her options if she is not covered?

From your description, her employer is not obligated to provide leave pursuant to the federal laws. However, there are also state laws which may provide some job protection. You should locate an experienced labor and employment law attorney in your area to review your situation and advise you as to your rights.
