Family Medical Leave Act - Medical Certification

The certification form filled out by the physician (if the physician used the Form WH-380) provides for a place to indicate whether the condition will require that the employee work intermittently. The employer may ask for recertification no more often than every 30 days. The employer may require recertification at a reasonable interval, other than the 30 day interval, if (1) the employee requests an extension of leave, (2) circumstances concerning the medical condition have changed significantly since the previous certification, or (3) the employer receives information which casts doubt on the continuing validity of the certification. These exceptions depend upon the particular facts and circumstances of each person's health problem and employment terms. An employee whose employer seeks certification more often than the 30 day period should consult an attorney, if the employee disagrees with the request for addtiional certification or recertification.
